These conditions, hereinafter Contract Conditions or Conditions, comprise all the existing agreements between you, hereinafter, the Client and Peocotón de Calanda Regulatory Council Denomination of Origin Protected company domiciled in Muro Santa Maria s / n Edificio Molino Mayor, 1 Floor, 44600 Alcañiz, (Teruel).

Both contracting parties reciprocally recognize the necessary legal capacity to sign these Conditions.

2. Conclusion of the Contract

When processing the corresponding order, the client declares to have read, understood and accepted these Conditions, so that the acceptance of the information contained in this document implies the acceptance of any of the legal documents to which, on the same, is refer specifically to the Privacy Policy, the Cookies Policy and the Purchase Manual, all of which imply the conclusion of a contract between the parties, that is, between the Client and Peach de Calanda Regulatory Council Protected Designation of Origin.

6. Purchase process

7. Payment

Payments by credit or debit card are made through the Stripe platform. The data related to the customer’s credit card is not stored on our website or in any of our databases, such data goes directly to the payment gateway of the responsible entity.

8. Shipping and delivery times

 Orders are prepared and sent from the different companies associated with the PDO. Therefore, you may receive packages from different production companies if you place orders on different occasions. Once the order has been placed, the transport company in charge of making the delivery is Nacex. If you place your order between Monday and Thursday at noon, you will receive it in 24 hours. Starting Thursday at 12:00 p.m. the order will be prepared the following Monday and will be delivered on Tuesday. It is recommended that the Customer have a flexible delivery schedule and that there is someone at the destination address who can take care of the purchased item. If no one is found at the indicated address, the transport agency will contact the client to set a new delivery date. The Regulatory Council Denomination of Origin “Peach of Calanda” will not assume any responsibility when the delivery cannot be made due to the fact that the information provided is inaccurate or incomplete, or due to the absence of the recipient, etc. The shipping price is € 6.15 for 1 box of peaches plus an additional € 1.75 for each successive box ordered.

9. Resolution of incidents
For any query or related incident, the Customer Service service is made available through the e-mail info@melocotondecalanda.com .

According to the provisions of article 103 of Royal Decree 1/2007, of November 16, the Client will not have the right to the return of goods that may deteriorate or expire quickly, such as the natural peach.

In case of receiving the product in poor condition, the Client must send a digital photograph by email to info@melocotondecalanda.com within 24 hours indicating:

– Customer name.
– Invoice number or order number.
– His phone number.
– The number of pieces in poor condition.
– Once the e-mail is received, the Customer Service Department will contact the Customer. In the event that the state of the product does not pass the quality standards established by the company, the Client may choose to request a refund of their money or to have the requested product sent again.

The return or claim for the poor condition of the product is not guaranteed if it has not been delivered in two visits due to the Customer. In the event of repeated returns or claims due to poor condition by the same Client, the Regulatory Council for the Denomination of Origin “Peach of Calanda” reserves the right not to make new shipments to the Client. Once the return is approved, we will proceed to make the payment by the same means of payment that was used to make the purchase. The return shipping costs are borne by the Customer, as long as this return is for reasons that do not meet our quality standard. The refund of your money will be made within a maximum period of thirty days.

10. Technical means to correct errors

12. Applicable Law and Jurisdiction

The contracting of products through the Peach de Calanda Regulatory Council Protected Designation of Origin website, in addition to the simple use of it, will be subject to Spanish legislation.

The parties agree, expressly waiving any forum that may correspond to them, to submit any divergences that may arise due to the execution and interpretation of this contract to the Courts and Tribunals of Alcañiz.

Based on the provisions of Clause 2 of this document, the signing of this document implies the acceptance by the parties of all and each one of the clauses contained therein.
